Do You Need Residency to Buy Property in Mexico?
The short answer is no: foreigners can buy property in Mexico without residency, through the bank trust (fideicomiso). However, having residency — temporary or permanent — brings concrete benefits that impact both quality of life and the buyer's tax and legal situation.
Temporary Residency: For Those Planning to Stay 1–4 Years
Temporary residency is the entry point for most foreigners settling in Mexico. Processed at the Mexican consulate in your home country, valid for 1 year, renewable up to 4 consecutive years.
2026 Economic Requirements
- By monthly income: passive income of at least approximately USD 1,600/month
- By assets: 12-month average bank balance of approximately USD 90,000
Benefits
With temporary residency you can open bank accounts more easily, obtain a tax ID (RFC), sign contracts in your name, and access medical services. You can also import a vehicle duty-free.
Permanent Residency: The Definitive Option
Permanent residency is Mexico's most solid immigration status. It never expires, requires no renewals, and grants nearly all rights of a Mexican citizen (except voting).
How to Obtain It
- High income: approximately USD 2,700/month in passive income or USD 500,000+ in assets
- Retiree/pensioner: with sufficient income
- Family ties: spouse or parent of a Mexican national
- Conversion from temporary: automatically after 4 years as temporary resident
Tax Impact by Residency Type
Without tax residency (tourist or non-resident)
When selling property without Mexican tax residency, the notary retains 25% of the gross sale price as income tax, with no deductions allowed. On a high-value property, this is a substantial tax burden.
With tax residency (permanent resident or temporary with 183+ days/year)
As a Mexican tax resident, you can declare the sale applying deductions (purchase price, improvements, closing costs) and pay income tax only on net gain. You also qualify for the primary home exemption of up to 700,000 UDIs (approx. USD 250,000).
The difference between these two scenarios can represent tens of thousands of dollars at sale time. For properties held more than 5 years, tax residency is a strategic financial consideration.
