The Mexican Notary: A Unique Figure
If you're from the U.S., Canada or most European countries, your concept of a "notary" is someone who certifies signatures. In Mexico, the Notario Público is entirely different: a government-appointed legal professional with authority to certify legal acts and significant tax responsibilities.
What the Notary Does in a Property Transaction
Identity verification: confirms all parties' identities. Deed drafting and validation: your definitive title document. Tax withholding and payment: legally required to withhold both seller's ISR and buyer's ISAI. Bank trust coordination: manages fideicomiso opening and SRE authorization. Public Registry inscription: property is formally in your name only after this registration.
What the Notary Does NOT Do
The notary is NOT your attorney. They don't defend your specific interests, evaluate whether the price is fair, inspect physical condition, or take responsibility for hidden unregistered problems. Always have your own independent real estate attorney.
Who Chooses the Notary?
In Mexico, the buyer traditionally chooses the notary. Exercise this right — don't passively accept the seller's or developer's preferred notary.
Notary Fees
In Quintana Roo: 0.5% to 1.5% of property value — approximately USD 1,000–3,000 on a USD 200,000 property.

Can I sign before a foreign notary?
Mexican real estate deeds must be signed before a Mexican public notary. Foreign notary powers of attorney must be apostilled and translated to Spanish.
Does the notary speak English?
Not all do. Ensure your attorney can accompany and translate during signing, or confirm the notary has bilingual support.
How long does deed signing take once documents are ready?
1-2 weeks. Bank trust opening typically causes the most delays.
