Why Does the Fideicomiso Exist?
Mexico's Constitution restricts foreigners from directly owning property within 50 km of the coastline or 100 km of land borders — the so-called restricted zone. Since the entire Riviera Maya falls within this zone, foreign buyers need a legal alternative: the bank trust (fideicomiso).
Far from being a limitation, the fideicomiso is a robust, well-regulated mechanism that grants you all practical rights of ownership, backed by a regulated banking institution.
How the Fideicomiso Works
A fideicomiso involves three parties:
- Fideicomitente: the seller or developer who transfers the property into the trust
- Fiduciario: the Mexican bank that legally holds the property (BBVA, Banamex, Santander, etc.)
- Fideicomisario: you, the foreign buyer, who holds all rights of use, enjoyment and disposition
The bank appears as legal owner in the public registry but acts solely on your instructions. You can live there, rent it, renovate it, sell it or pass it to heirs — freely and without restriction.
Duration and Costs
The trust has an initial term of 50 years, renewable indefinitely. Setup costs range from USD 800–1,500, and annual administration fees are USD 500–800 depending on the bank.
Can the Bank Take My Property?
No. The bank acts only as trustee — an administrative role with no economic interest in the property. It cannot sell or encumber the property without your explicit authorization. Your rights as beneficiary are fully protected by law and are independent of the bank's financial situation.
Fideicomiso vs. Mexican Company
A Mexican corporation is an alternative for investors with multiple properties or significant rental income. For most individual buyers, the fideicomiso is simpler, cheaper and equally secure.
Inheritance Planning
You can designate substitute beneficiaries from day one. If something happens to you, the property passes directly to your named heirs without a Mexican probate process — a major advantage over other legal systems.
