5 key advantages of working with a licensed real estate advisor

In the Riviera Maya real estate market, there are two kinds of advisors: those who work with a current license issued by the competent authorities, and those who don't. This difference has very concrete practical and legal consequences for buyers and investors. Here are the five most important advantages of working exclusively with licensed advisors.

Advantage 1: Legal protection before regulatory bodies

The Quintana Roo State Law on Professional Real Estate Practice, in force since 2023, establishes that only advisors with an active license from SEDETUR (the State Tourism Department) may legally act as real estate intermediaries in the state. An unlicensed advisor is operating outside the legal framework.

The practical consequence for the client is crucial: if something goes wrong with an unlicensed advisor, the buyer has no one to turn to within the regulatory system. The only option would be the ordinary court system, which is costly and slow.

With a licensed advisor, there is a direct regulatory authority: SEDETUR can receive formal complaints, investigate, and impose sanctions. That ability to file a formal complaint is real protection, even if hopefully you never need to use it.

Advantage 2: Certified, up-to-date technical training

A real estate license in Quintana Roo is not granted automatically. It requires proof of specific training in areas including real estate law, the fideicomiso (bank trust), property valuation, professional ethics, and environmental regulations applicable to the sector.

AMPI (the Mexican Association of Real Estate Professionals), whose membership complements the state license, also requires continuing education: its members must regularly update their knowledge to maintain active status. This ensures the advisor you work with knows the latest regulations, including changes in tax policy and environmental regulations from SEMARNAT.

An unlicensed advisor may have hands-on experience, but has no obligation to undergo verified technical training. And in a market where technical mistakes can cost tens of thousands of dollars, the difference matters.

Advantage 3: Access to privileged information networks

Licensed advisors who are active in AMPI have access to information that is not publicly available: comparable transaction data, exclusive property inventories, early warnings about developers with problems, pending regulatory changes, and pre-sale opportunities before public launch.

This market information is the fuel of sound investment decisions. At L'Agence MX, our licensed advisors and active AMPI members have first-hand access to this information network. It is an asset we pass directly on to our clients.

Advantage 4: A Code of Ethics with verifiable obligations

AMPI membership and SEDETUR licensing require adherence to a Code of Professional Ethics that sets out concrete obligations:

  • Always act in the client's interest, not one's own
  • Disclose any conflict of interest (seller commissions, exclusivity agreements)
  • Never withhold relevant information about the property
  • Keep client data confidential
  • Honor agreed fees with no hidden charges

These obligations are formally enforceable. An advisor who breaches them can be sanctioned, suspended, or expelled from the organization. This creates a system of incentives in which ethical compliance has real consequences.

Advantage 5: A higher likelihood of closing successful transactions

Licensed advisors with verified experience have a significantly higher rate of successfully closed transactions than informal advisors. They know the process: what documentation to request from day one, what red flags to look for in a property title, how to negotiate effectively with notaries and trustee banks, and how to resolve the problems that inevitably arise in complex transactions.

The advisors on the L'Agence MX team have a track record of hundreds of closed transactions in the Riviera Maya, with clients from more than 30 countries. That experience can't be transferred, but its benefits are passed on to every new client.

Current license vs. expired license: a detail that matters

An important technical detail that is often overlooked: a real estate license has an expiration date and must be renewed periodically to remain valid. An advisor who obtained a license 3 years ago but hasn't renewed it is technically not operating with current legal backing, even if they show the old license document as though it were current. That's why, in addition to asking for the license number, it's important to check the expiration date on the physical document and confirm it on the SEDETUR Quintana Roo portal, which shows the current status of the registration (active or expired) in real time.

International organizations that recognize AMPI

AMPI is affiliated with the U.S. NAR (National Association of Realtors), the largest real estate organization in the world, through a reciprocity agreement that allows members of both associations to benefit from each other's networks and resources. It also has alliances with real estate organizations in Canada, Spain, France, and other countries. For a foreign buyer, this international backing adds an extra layer of confidence in the advisor they work with.
