Fractional Ownership in the Riviera Maya: How to Invest Starting at $50,000 USD

You do not need to buy an entire property to own real estate in Cancun, Tulum, Playa del Carmen, Puerto Aventuras, or Bacalar.

What It Is and Why It Is Not a Timeshare

A timeshare sells you weeks of use. Fractional ownership sells you a real percentage of a real estate asset, legally registered. You participate in the appreciation, receive proportional rental income, and can sell your share.

Three Available Models

SPV (Special Purpose Vehicle): A Mexican company whose sole asset is the property. You purchase proportional shares. The most widely used model in the high-end segment, especially for villas in Playacar Phase II, premium condominiums in Aldea Zama, and oceanfront properties in the Cancun Hotel Zone.

Direct Co-ownership: 2 to 6 buyers with a percentage registered in the Public Registry. Simple, but requires a solid co-ownership agreement. Works well for properties in Puerto Aventuras and Bacalar, where the individual ticket is more accessible.

Real Estate Tokenization: Tickets from $10,000 to $50,000 via digital platforms. Greater liquidity.

Legal Framework for Foreigners

The fideicomiso is shared among co-owners. Costs ($500 to $1,200 USD annually) are split. An independent attorney must review the structure. This applies to properties in all coastal cities of Quintana Roo, from Isla Mujeres to Mahahual.

Expected Returns

Full property in Aldea Zama, Tulum: 6% to 9% gross annually. With a 25% fraction at $100,000 USD: net yield of 4% to 7% annually plus proportional appreciation. The advantage: diversification instead of concentrating $400,000 in a single asset. You can hold a fraction in Tulum, another in Playacar, and another in the Puerto Aventuras Marina, covering three distinct markets with different rental profiles.

Advantages and Disadvantages

Advantages: Access to premium locations such as Aldea Zama, Playacar, the Bacalar Lagoon, or Playa Norte in Isla Mujeres. Diversification, included management, lower risk exposure.

Disadvantages: Limited liquidity, partial control, dependence on the operator, limited personal use (8 to 12 weeks/year).

Frequently Asked Questions

Can I finance it? Some developers in Tulum, Playa del Carmen, and Cancun offer 30% down payment with 12 to 24 months of installments.

What taxes do I pay? Proportional property tax, ISR on rental income, ISR on capital gains when selling.

Can I pass my fraction to my heirs? Yes, through the fideicomiso or the company.

What happens if I want to sell and the other owners do not want to buy? The co-ownership agreement includes a right of first refusal with a deadline, and if no one exercises it, you can sell to a third party.
