Pre-construction investment in the Riviera Maya: advantages, considerations and how to protect yourself

Pre-construction real estate is one of the most popular investment vehicles in the Riviera Maya, and for good reason: historically, buyers who get in at the early stages of a well-chosen project can see their investment grow by 20% to 35% from launch price to delivery, according to market data compiled by CANADEVI (Mexico's National Chamber of the Housing Development and Promotion Industry) and benchmarks from industry operators.

But like any high-potential investment, pre-construction also has its complexities. Going in without the right information can lead to prolonged delays, insolvent developers or properties that don't deliver on their promises. This guide explains how the pre-construction market works in the Riviera Maya, which documents to verify and how to structure the transaction to maximize buyer protection.

What exactly is pre-construction real estate?

Pre-construction (preventa) is the sale of real estate units before a project is finished — and in many cases before construction has even started. The developer offers launch prices below the projected market value in exchange for upfront capital to finance construction.

Payment plans vary, but a typical structure in the Riviera Maya might be:

  • 10% to 30% upon signing the promise-to-purchase agreement
  • 30% to 50% during construction, in monthly installments
  • 20% to 40% at closing and delivery

Some projects offer more flexible plans, including the option of direct financing with the developer, with no need for a bank mortgage.

Where does pre-construction appreciation come from?

  • Discount for risk and timing: the buyer takes on the risk that the project won't be completed as promised, and in return receives a preferential price
  • Area appreciation: while the project is being built, the surrounding area can gain value thanks to new developments, infrastructure or growing tourist flows
  • Rising construction costs: materials and labor keep getting more expensive, which pushes up the final price of equivalent properties built later
  • Inventory scarcity in established areas: in areas such as Tulum, Playacar or Puerto Morelos, available land is increasingly limited

The guarantee trust: your main protection in pre-construction

The most important protection mechanism for a pre-construction buyer is the fideicomiso de garantía (guarantee bank trust). Unlike the bank trust used to hold title to property, the guarantee trust is a specific instrument in which the buyer's payments are deposited into an account controlled by a neutral trustee bank, which releases them to the developer based on verified construction progress.

This means that if the developer goes bankrupt or abandons the project before completion, the trustee bank protects the deposited funds. At L'Agence MX we only present pre-construction projects from developers with a verifiable track record and, whenever possible, with a guarantee trust. It is one of our non-negotiable policies.

Pre-construction due diligence: what to verify before signing

  • Land title: clean, free of liens and free of ejido (communal land) disputes. This is the most common and costly mistake in the Riviera Maya.
  • Valid construction permits: the Municipal Construction License and permits from SEMARNAT (Mexico's environmental agency) if the project has an environmental impact
  • Developer track record: previous projects delivered on time and as promised
  • Verifiable capital: the developer must demonstrate sufficient financial solvency to complete the project
  • Promise-to-purchase agreement with penalty clauses: what happens if there are delays, and what the termination conditions are, including the return of capital

Current pre-construction markets in the Riviera Maya 2026

The most active pre-construction markets in 2026, according to L'Agence MX's tracking, are:

  • Tulum: still the epicenter of luxury pre-construction. Wellness, eco-luxury and boutique projects maintain launch prices between USD 150,000 and USD 600,000 per unit, with sustained appreciation projections.
  • Puerto Morelos: emerging. Less supply but high demand. Projects are smaller and more exclusive, with competitive launch prices and solid appreciation projections.
  • Northern Playa del Carmen: the city's northward expansion is generating interesting projects with a good price-to-potential ratio.

When is the right time to sell a property bought pre-construction?

A question that often comes up among pre-construction investors is when to sell to maximize returns. There are three typical windows: before delivery (assigning your rights to a new buyer), right after delivery once the completed project is up and running with its amenities operational, or after 2 to 3 years once the surrounding market has matured and resale demand is broader. Each window has its own advantages and distinct tax considerations. At L'Agence MX we advise our clients not only on the purchase but also on the exit strategy, so that a pre-construction investment is as smart at the time of sale as it was at the time of purchase.
